Terms of service
In effect from 21 October 2026
These terms cover your use of Crowdboard, the survey game at crowdboard.app, including its website, apps and any paid plan. Crowdboard is run by Techstus Software Solutions Limited, a company registered in Kenya under number PVT-27U5JMEZ ("we", "us"). By creating an account, buying a plan or hosting a game you agree to these terms. If you use Crowdboard for a company or another organization, you agree to them on its behalf and confirm you're allowed to.
1. Who can use it
Hosts need an account, and must be at least 16 and old enough to make a binding contract where they live. Players join a game with a room code and a display name, with no account; a host who invites players under 16 is responsible for having their parent's or guardian's permission where the law requires it.
Keep your sign-in email secure: anyone who can read it can sign in as you. The Owner of a team decides who joins it and what role each person has, and is responsible for how the team's members use Crowdboard.
2. Plans, payment and Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the merchant of record for all our orders. Paddle takes the payment, charges any sales tax or VAT, and handles billing questions, invoices and refunds. When you buy a plan you also accept Paddle's buyer terms, which Paddle shows at checkout.
- Monthly and yearly plans renew automatically at the end of each period until you cancel. You can cancel at any time, and your plan keeps working to the end of the period you paid for.
- An Event pass gives Pro for 7 days and does not renew.
- Prices are listed on the pricing page. If we change the price of your plan, we'll tell you at least 30 days before it applies to you, and you can cancel before then.
- If a renewal payment fails, your plan keeps working for 7 days while Paddle tries again. After that your team moves to the Free plan. Nothing is deleted: games and topics beyond the Free limits become read-only until you upgrade again.
- Refunds follow our refund policy.
3. Your content
Games, questions, topics, team names and anything else you put into Crowdboard stay yours. You give us permission to store, copy, show and send that content only as needed to run Crowdboard for you and your team, for example to show your game on the TV and on players' phones.
You're responsible for your content and for having the right to use it. Don't put in anything that is unlawful, that infringes someone else's rights, or that is hateful, harassing or sexually explicit. We may remove content that breaks these terms, and we'll tell you when we do unless the law stops us.
4. Fair use
When you use Crowdboard, don't:
- break the law, or use it to harass, deceive or harm anyone;
- try to get around plan limits, access other teams’ data, or test, probe or attack our systems without our written permission;
- copy, scrape or resell the built-in question bank, or the app itself, outside games played on Crowdboard;
- use players’ names or anything else from a game to contact, track or profile people without their permission;
- overload the service, for example with automated traffic.
5. Our content
The Crowdboard app, its design and its built-in questions belong to us or our licensors. While your account is in good standing you may use them to host games on Crowdboard, including at paid events you run. These terms don't give you any other rights in them, or in our name and logo.
6. Changes and availability
We work to keep Crowdboard running and secure, but we can't promise it will always be available or free of errors. We may change, add or remove features. If a change takes away something important from a paid plan, we'll tell you in advance, and you can cancel and get a pro-rata refund for the unused part of a yearly plan.
7. Ending your use
You can stop using Crowdboard at any time, and close your account yourself on your account page, or ask us to by writing to support@crowdboard.app. We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it; unless the problem is urgent or the law forbids it, we'll warn you first and give you a chance to fix it.
When an account or team is closed, its access ends and its content is deleted within 30 days, except what we must keep by law. You can export your games and topics as files from the game editor at any time before then. Sections 3, 5 and 8 to 12 still apply after your use ends.
8. Disclaimer
Crowdboard is provided "as is". As far as the law allows, we make no promises beyond those in these terms, for example that it will suit a particular purpose. Built-in questions and answers are made with care, but survey results and facts can be dated or disputed, so the host has the final say in a game.
9. Liability
As far as the law allows, we are not liable for indirect or consequential losses, or for lost profits, revenue, data or goodwill. Our total liability for any claim about Crowdboard is limited to the amount you paid for it in the 12 months before the claim, or $50 if you paid nothing. Nothing in these terms limits liability that the law does not allow us to limit, such as for death or personal injury caused by negligence, or for fraud, and nothing takes away rights you have as a consumer under the laws of the country you live in.
10. Indemnity
If you use Crowdboard for a business or other organization, you'll cover our reasonable costs, including legal fees, of any claim by someone else that arises from your content or from your breaking these terms.
11. Events beyond our control
We're not responsible for delays or failures caused by events beyond our reasonable control, such as outages at our hosting or network providers, power cuts, natural disasters, war, strikes or government action.
12. Law and disputes
If something goes wrong, write to us at support@crowdboard.app first: most problems can be fixed quickly that way. These terms are governed by the laws of Kenya, and the courts of Kenya can settle any dispute about them. If you're a consumer, you also keep the protection of the mandatory laws of the country you live in, and can bring a claim in its courts.
13. Everything else
- We may transfer these terms to someone who takes over Crowdboard, as long as your rights under them don’t get worse. You may not transfer them without our written agreement.
- If a court finds part of these terms unenforceable, the rest still applies.
- If we don’t enforce a right straight away, we can still enforce it later.
- These terms, the privacy notice and the refund policy are the whole agreement between you and us about Crowdboard.
- We may update these terms. For a change that matters, we’ll tell account holders by email or in the app at least 30 days before it applies. Using Crowdboard after that means you accept the new terms; if you don’t, you can cancel.
